These Terms and Conditions (“Terms”) govern your use of the website, products, programs, and services provided by Caron Modern Media (“Caron Modern Media,” “Company,” “we,” “us,” or “our”).

By accessing our website, purchasing a product or service, booking a session, enrolling in a program, or otherwise using our services, you agree to these Terms.

1. Services

Caron Modern Media provides photography, videography, video marketing, media coaching, social media strategy and management, workshops, speaking engagements, educational resources, and related creative and consulting services.

Specific services, deliverables, timelines, fees, and other terms may be described in a separate proposal, contract, statement of work, booking agreement, or purchase page. If a separate written agreement conflicts with these Terms, the terms of the separate agreement will control for that service.

We reserve the right to modify, discontinue, or refuse services at our discretion, subject to applicable law and existing contractual obligations.

2. Payment Terms

Payment is due according to the terms presented at booking, checkout, or in your individual service agreement.

You agree to provide current, complete, and accurate billing and payment information.

For payment plans, you authorize us or our third-party payment processor to charge the payment method provided according to the agreed payment schedule.

Unless otherwise stated in writing, purchasing a program or service commits you to the full purchase price, even when a payment plan is used.

We reserve the right to pause, cancel, or withhold services or deliverables for overdue payments, failed payments, suspected fraud, or other payment issues, subject to applicable law.

3. Coaching and Educational Disclaimer

Caron Modern Media provides education, strategy, coaching, and guidance related to video marketing, social media, online visibility, content creation, and related business topics.

We do not guarantee specific business, financial, marketing, social media, audience growth, lead generation, or sales results.

Your results depend on many factors outside our control, including your participation, implementation, business model, audience, market conditions, platform changes, and other circumstances.

Any examples, testimonials, case studies, or past client results are provided for illustrative purposes only and are not guarantees that you will achieve the same or similar results.

You remain responsible for your own business decisions, implementation, and results.

4. Photography and Videography Services

Photography and videography services may be subject to additional terms provided in a booking agreement, proposal, or client contract.

Clients are responsible for arriving on time and prepared for scheduled sessions and for securing any locations, permissions, releases, wardrobe, products, props, or other materials required of them unless otherwise agreed in writing.

Creative services involve professional judgment. By hiring Caron Modern Media, you acknowledge that photography, videography, editing, composition, and other creative decisions may reflect our professional and artistic style.

Delivery dates and the number and format of final files will be specified in the applicable agreement or service description.

Raw, unedited, or source files are not included unless specifically stated in writing.

5. Client Content and Permissions

You retain ownership of materials you provide to us, including logos, trademarks, photographs, videos, written content, and other intellectual property you own.

By providing these materials, you represent that you have the legal right to use them and authorize Caron Modern Media to use them as reasonably necessary to perform the requested services.

You are responsible for obtaining any permissions, releases, licenses, or approvals required for people, locations, music, trademarks, copyrighted works, or other third-party materials you ask us to incorporate into your project.

You agree not to provide materials that infringe another person’s intellectual property, privacy, publicity, or other legal rights.

6. Intellectual Property

Unless otherwise stated in a separate written agreement, all original educational materials, coaching materials, templates, guides, training videos, presentations, methods, website content, graphics, and other materials created by Caron Modern Media remain the intellectual property of Caron Modern Media.

Purchasing or accessing our materials gives you a limited, personal, non-exclusive, non-transferable license to use them for your own business or personal purposes.

You may not copy, reproduce, resell, distribute, publish, teach, sublicense, share access to, or create derivative commercial products from our materials without written permission.

Ownership and usage rights for photography, videography, and other commissioned creative work will be governed by the applicable client agreement. No copyright or ownership transfer should be assumed unless expressly provided in writing.

7. Portfolio and Promotional Use

Photography, video, testimonials, client names, logos, or project materials will only be used for portfolio, website, social media, advertising, educational, or promotional purposes to the extent permitted by the applicable client agreement, model release, testimonial authorization, or other consent.

Where separate permission is required, we will seek that permission before using the material.

8. Third-Party Platforms

Our services may involve third-party platforms and tools such as Instagram, Facebook, LinkedIn, Canva, scheduling platforms, payment processors, email providers, website platforms, or other technology services.

Caron Modern Media does not own or control these third-party platforms and cannot guarantee their continued availability, functionality, policies, algorithms, features, reach, or performance.

Platform changes, account restrictions, outages, algorithm changes, or decisions made by third-party providers are outside our control.

Your use of third-party services may also be governed by their own terms and privacy policies.

9. SMS Messaging Terms

When you provide your mobile number and consent to receive text messages from Caron Modern Media, we may send messages related to appointments, services, account activity, reminders, follow-up communications, and, where you have consented, promotional or marketing messages.

Message frequency varies.

Message and data rates may apply.

You can opt out of SMS messages at any time by replying “STOP.” After your opt-out request is processed, you may receive a final confirmation message and will no longer receive SMS messages unless you opt in again.

10. Cancellation and Rescheduling

Cancellation and rescheduling requirements may vary depending on the service purchased and will be provided at booking or in the applicable client agreement.

Unless a different policy is stated for a particular service, appointments and sessions must be canceled or rescheduled at least 24 hours in advance.

Late cancellations, missed appointments, or no-shows may result in forfeiture of payments, deposits, session time, or a cancellation fee as permitted by the applicable agreement and law.

For longer coaching programs, projects, photography or videography engagements, workshops, or other contracted services, the cancellation, rescheduling, refund, and termination terms in the applicable agreement will control.

11. Refunds

Refund eligibility varies by product or service and will be stated at checkout, in the applicable service description, or in your client agreement.

Because coaching, consulting, digital products, customized creative work, photography, videography, and reserved appointment time may involve immediate work, preparation, access, or capacity commitments, payments may be non-refundable once services have begun or digital materials have been accessed, except where otherwise required by law or agreed in writing.

12. Automatic Renewals

If Caron Modern Media offers a subscription, membership, continuous service, or automatically renewing product, the renewal terms, billing frequency, price, cancellation method, and other material terms will be disclosed before enrollment.

Where required by law, we will obtain your affirmative consent before enrolling you in automatic renewal and provide required notices and cancellation options.

13. Website Use

You agree not to misuse our website or services, attempt to gain unauthorized access to our systems, interfere with website operation, introduce malicious code, scrape protected content, impersonate another person, or use our website or materials for unlawful purposes.

We may restrict or terminate access when we reasonably believe these Terms have been violated.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Caron Modern Media will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from your use of our website, services, programs, products, or materials.

To the fullest extent permitted by law, our total liability for a claim related to a specific paid service will not exceed the amount you paid to Caron Modern Media for the service giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Caron Modern Media and its owners, employees, contractors, and agents from claims, losses, liabilities, or expenses arising from your unlawful misuse of our services, your violation of these Terms, materials you provide to us, or your infringement of another person’s rights.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Subject to any dispute resolution terms contained in a separate client agreement and applicable law, disputes arising from these Terms will be resolved in the appropriate state or federal courts located in California.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.

18. Changes to These Terms

We may update these Terms periodically to reflect changes to our services, business practices, or applicable law.

Updates will be posted on this page with a revised effective date. Your continued use of the website or services after an update constitutes acceptance of the revised Terms to the extent permitted by law.

19. Privacy

Your privacy is important to us. Our collection, use, disclosure, and protection of personal information is governed by our
